The Legislative Decree
97/2016 has significantly changed the institution of civic access.
The request for civic access is the generalized right of
citizens to access information concerning the organization and
activities of public administrations.
It is possible to request documents, the information or data that
Educational institutions must publish according to the relevant legislation
(D.Lgs. 14/03/13 n. 33), that on the website of the I.C.. Via Palestro are contained in the
"Transparent Administration" section. The institution of civic access is
provided for by art. 5 of Legislative Decree n. 33 of 14/03/2013.
How
exercise the right of civic access
The request
it's free, it must not be motivated and must be addressed to the person in charge of the
Transparency. It can be drawn up on the specially prepared form
(downloadable at the bottom of the page) and presented:
- by e-mail at the address MIIC8E7007@ Formazione.it ;
- by e-mail certified at the address: MIIC8E7007@pec.istruzione.it;
- by ordinary mail at : I.C. T.Terzani, Via Legnano 92 20081 Abbiategrasso (ME)
- directly at the office Protocol of the school I.C. T.Terzani, Via Legnano 92 20081 Abbiategrasso (ME);
Procedure
The Head of Transparency, after receiving the request, there
transmits to the person responsible for the publication by subject and informs the
applicant.
The person responsible for the publication, within 20 days, publish on the website icterzani.edu.it,
Transparent Administration section, the document, the information or data
required and, at the same time, communicates to the Transparency Manager
the successful publication, indicating the relative hyperlink;
otherwise, if what has been requested is already published, in compliance with the
current legislation, notifies the Transparency Manager,
indicating the relative hyperlink
The Head of Transparency, once received communication from the
responsible for publication, notifies the successful publication, pointing
its hyperlink, to the applicant.
Protection
of civic access
Against the
decisions and against silence on the related civic access request
the non-fulfillment of the transparency obligations the applicant can propose
appeal to the administrative judge within thirty days from the knowledge of the
decision of the Administration or the formation of silence.
